  • “Platform” – the website www.take2eu.com and all associated digital infrastructure owned and operated by Take2EU.
  • “Account” – the personal user account created upon registration, containing the User’s profile, CV, documents, and personal information.
  • “Package” – one of the available visibility or support packages offered by Take2EU (Fast-Pack, Express-Pack, Priority-Pack).

1.2 Scope of Terms

These Terms govern the relationship between Take2EU and Users of the Platform. By creating an Account, accessing the Platform, or making a purchase, the User accepts these Terms in full. If the User does not agree with any provision, the User must discontinue use of the Platform immediately.

  1. NATURE OF SERVICE – NOT AN EMPLOYMENT AGENCY

2.1 Digital Visibility Service

Take2EU provides exclusively a digital career visibility and profile optimisation service. The Service includes, in particular:

  • Hosting User profiles in a searchable database.
  • Formatting and presenting User information to Employers.
  • Providing email notifications to Employers about User profiles.
  • Offering general guidance on CV optimisation and European labour market trends.
  • Facilitating visibility of User profiles to registered Employers.
  • Providing document review and formatting support.

2.2 What Take2EU IS NOT

Take2EU explicitly does not provide and is not:

  • An employment agency, recruitment agency, labour placement service, or temporary staffing provider.
  • A visa, immigration, or work permit consultancy.
  • A party to employment negotiations or employment contracts.
  • An agent authorised to represent Employers in hiring decisions.
  • A guarantor of job interviews, job offers, employment, or employment terms.
  • A provider of work authorisation, visa sponsorship, relocation assistance, or immigration services.
  • Responsible for working conditions, wages, benefits, or legality of employment offered by Employers.

2.3 Exclusive Purpose

The sole purpose of Take2EU’s Service is to increase the visibility of User profiles to Employers and to provide supportive information about the European labour market. Take2EU does not mediate, negotiate, or conclude employment relationships.

  1. NO GUARANTEES AND NO LIABILITY FOR EMPLOYMENT OUTCOMES

3.1 No Employment Guarantees

The User explicitly acknowledges and agrees that:

  • Take2EU does not guarantee job interviews, job offers, employment, employment terms, or any specific employment outcome.
  • Take2EU does not guarantee contact from Employers or responses to inquiries from Employers.
  • Take2EU does not guarantee that the User’s profile will result in any communication with or interest from any Employer.
  • Take2EU does not guarantee that any Employer will view the User’s profile, even if the User has purchased a visibility package.
  • Employer interest, contact, and hiring decisions are made exclusively by Employers at their sole discretion, based on their business needs, and are entirely independent of Take2EU.

3.2 Market Risk

The User acknowledges that labour market conditions change constantly. The availability of job opportunities, the demand for specific skills, and Employer hiring decisions are beyond Take2EU’s control and depend on factors including, but not limited to:

  • General economic conditions.
  • Industry and sector trends.
  • Employer hiring cycles.
  • User qualifications and experience.
  • Competition from other candidates.
  • Regional labour market dynamics.
  • Visa, work permit, and legal employment requirements in target countries.

Take2EU assumes no liability or responsibility for these factors.

3.3 Visibility ≠ Results

Increased visibility through Take2EU does not guarantee employment success. The User may purchase the highest visibility package and receive no Employer interest. Conversely, a User on a basic package may receive unsolicited Employer contact. Take2EU provides visibility tools; employment outcomes depend entirely on Employers’ independent decisions.

To use the Service, the User must:

4.3 Breach by User

If the User provides false, inaccurate, or misleading information, the User shall be solely responsible for:

  • Any damages, losses, or claims arising from such misrepresentation.
  • Take2EU’s costs of investigation, correction, or removal of false information.
  • Any reputational, financial, or legal harm to Employers or third parties.
  • Potential criminal liability under fraud or misrepresentation laws.

Take2EU reserves the right to suspend or terminate the Account immediately upon discovery of false information.

5.3 Payments are processed through Tpay, operated by Krajowy Integrator Płatności S.A., with its registered office in Poznań, Poland (KRS: 0000412357, NIP: 7773061579).
Tpay acts as an independent payment service provider and processes payment data in accordance with its own terms and applicable payment regulations.
Take2EU does not store full card details or sensitive payment credentials. All payment data is encrypted and processed directly by Tpay.

5.4 Failed Payments

If a payment fails, Take2EU will attempt to process the payment again. If payment is not successful after multiple attempts, the Service activation or renewal will be delayed or suspended until payment is received. Take2EU is not responsible for service interruptions due to failed payments.

  1. DIGITAL SERVICE – START, WITHDRAWAL RIGHT, AND DURATION

6.1 Digital Service Nature

The Service is a digital service delivered online and is not a physical good. The Service begins upon the earliest of:

  • Account activation and creation of a searchable profile on the Platform.
  • Upload of User documents to the Platform infrastructure.
  • Commencement of visibility activities (profile indexing, Employer notifications, or similar actions).

This occurs after payment is successfully processed.

6.2 Request for Immediate Performance and Information on Withdrawal

At checkout, the User is clearly informed that:

  • The Service is a digital service.
  • By ticking the mandatory checkbox and placing the order, the User explicitly requests and consents to the immediate start of the digital Service before the expiry of the statutory withdrawal period.
  • The User acknowledges that, once the Service has begun in full, the statutory consumer right of withdrawal is forfeited in accordance with Article 16(m) of Directive 2011/83/EU (Consumer Rights Directive) and equivalent provisions in applicable national consumer protection laws.

The request for immediate performance and information on the loss of the right of withdrawal are presented to the User in a clear and separate manner from other terms and consents.

6.3 No Right of Withdrawal After Service Activation

In accordance with consumer protection laws, the User has the right to withdraw from the purchase within 14 days of payment only if the Service has not yet been activated. Once the Service has started (Account activated, documents processed, profile made searchable, or visibility activities commenced), the User has no right to withdraw, cancel, or receive a refund, regardless of whether the User has actually used the Service or achieved any employment results.

6.4 Package Duration

Each Package is valid for the stated number of days from the date of activation. Visibility benefits expire automatically at the end of the chosen period. The User will receive email notification before automatic renewal.

6.5 Renewal and Cancellation of Subscription

  • Packages renew automatically at the end of each cycle unless the User actively cancels in the Account settings at least 48 hours before renewal.
  • Cancellation must be made via the Platform’s Account settings or by written request to the support email address indicated in these Terms.
  • Cancellation is effective at the end of the current billing period; no refunds are issued for the ongoing billing period.
  • The User can cancel at any time with no minimum subscription period beyond the current billing cycle.
  1. REFUND AND CANCELLATION POLICY

7.1 Non-Refundable Fees After Activation

Once the Service has started in accordance with Section 6, all fees paid are non-refundable and non-creditable. Take2EU does not provide refunds or credits in the following illustrative (non-exhaustive) situations:

  • Lack of Employer contact or interest.
  • Lack of job interviews, job offers, or employment opportunities.
  • User dissatisfaction with the Service.
  • User decision not to pursue employment in Europe.
  • Market conditions or lack of relevant job openings.
  • User’s personal circumstances changing.
  • User’s qualifications or experience not meeting Employer expectations.
  • No response from Employers despite visibility.

7.2 Pre-Activation Refund – Limited Exceptions

If the User has made payment but the Service has not yet been activated (no Account creation, no document processing, no profile made searchable, and no visibility activities), the User may request a full refund within 14 days of payment by contacting the support email address with proof of payment.

The User may be required to provide reasonable evidence that the Service has not been activated (e.g. no account login, no profile creation).

7.3 Pay Terms

Refund requests and payment disputes (including chargebacks) are handled in accordance with the rules and procedures of Tpay and, where applicable, the relevant card schemes (e.g. Visa, Mastercard).
If a User initiates an unjustified chargeback after Service activation, Take2EU reserves the right to suspend the Account and pursue recovery of the disputed amount and related processing fees.

7.4 No Refund for Chargebacks After Activation

If a User initiates a chargeback or payment dispute after the Service has been activated, the Account will be immediately terminated. Take2EU may pursue recovery of the disputed amount plus any applicable processing fees and legal costs, to the extent permitted by law.

  1. USER CONDUCT AND PROHIBITED ACTIVITIES

8.1 Prohibited Conduct

The User shall not:

  • Upload false, fraudulent, or misleading information, qualifications, or identity.
  • Impersonate another person or entity.
  • Upload Content that is defamatory, obscene, or illegal.
  • Use the Platform for any unlawful purpose or in violation of any local, national, or international law.

  • Engage in any form of fraud, misrepresentation, or scam.
  • Use the Platform to solicit services, referrals, or money from Employers under false pretences.
  • Interfere with the operation or security of the Platform.

8.2 Consequences of Violation

If Take2EU has reasonable grounds to believe the User has engaged in prohibited conduct, Take2EU may:

  • Immediately suspend or terminate the Account.

  • Report the User to relevant authorities.
  • Pursue civil or criminal claims against the User.
  • Cooperate with law enforcement investigations.

The User may view and print such Content solely for personal, non-commercial use, unless otherwise expressly authorised.

By uploading Content to the Platform, the User grants Take2EU a worldwide, non-exclusive, royalty-free, perpetual licence to:

  • Store, copy, and display the Content on the Platform.
  • Share the Content with Employers and other registered Users as part of the Service.
  • Use the Content for Service delivery and Platform improvement.
  • Retain the Content even after Account termination where necessary for legal compliance, backup, or dispute resolution purposes.

9.3 User Ownership

The User retains ownership of the Content uploaded. The User is solely responsible for ensuring that the Content does not infringe third-party rights, including intellectual property, privacy, and personality rights.

  1. DATA PROTECTION, PRIVACY, AND INTERNATIONAL DATA TRANSFER

10.1 Applicability of Privacy Policy

The processing of User Personal Data is governed by Take2EU’s Privacy Policy (available on the Platform), which is incorporated into these Terms by reference.

10.2 Data Processing for Service Delivery

To provide the Service, Take2EU must process User Personal Data, including, in particular:

  • Contact information (name, email, phone).
  • Professional information (CV, qualifications, work experience).
  • Profile information and preferences.
  • Payment-related information (to the extent necessary for processing through Przelewy24).
  • Log and activity data related to use of the Platform.

10.3 International Data Transfer – India, Bangladesh, Philippines

Take2EU discloses that User Personal Data may be processed and stored in the following jurisdictions outside the European Economic Area (EEA):

  • India (e.g. data hosting, CRM systems, customer support).
  • Bangladesh (e.g. customer support, document processing).
  • Philippines (e.g. customer support, profile management).

Users from the EEA and other jurisdictions should note that these countries do not have data protection laws equivalent to the GDPR. By using the Service, the User explicitly consents to the transfer and processing of Personal Data in these jurisdictions in accordance with this Section and the Privacy Policy.

10.4 Legal Safeguards for International Transfer

To comply with GDPR and applicable international data protection laws, Take2EU employs the following mechanisms to protect data in international transfers:

  1. a) Standard Contractual Clauses (SCC)

Take2EU implements and relies on Standard Contractual Clauses (SCC) as approved by the European Commission with all subprocessors located in India, Bangladesh, and the Philippines, where applicable. These Clauses create a contractual framework intended to ensure that Personal Data receives a level of protection that is substantially equivalent to GDPR standards, even in jurisdictions without equivalent data protection laws.

  1. b) Sub-Processor Agreements

All subprocessors (such as hosting providers, CRM providers, and support vendors) in India, Bangladesh, and the Philippines are bound by:

  • Written Data Processing Agreements (DPAs).
  • Commitments to implement appropriate technical and organisational security measures.
  • Restrictions on data use to the specific purposes stated by Take2EU.
  • Restrictions on further sub-processing without written consent.
  • Contractual provisions that allow Take2EU, and where appropriate Users or regulators, to audit and verify compliance.
  1. c) Supplementary Measures

Where appropriate, Take2EU also relies on supplementary measures, including:

  • Encryption and pseudonymisation of data.
  • Access controls and role-based access permissions.
  • Staff training on data protection and confidentiality.
  • Internal policies and procedures for handling data subject requests and incidents.

10.5 Risks of International Transfer

Despite the safeguards listed above, the User acknowledges that:

  • Public authorities in India, Bangladesh, and the Philippines may have broader powers to access personal data under local laws.
  • Law enforcement or security agencies in these jurisdictions may request access to personal data.
  • The legal protections and rights available in these jurisdictions may be less comprehensive than those in the EEA or the User’s home jurisdiction.
  • No transfer mechanism can entirely eliminate the risks associated with cross-border data flows.

By using the Service, the User acknowledges and accepts that such risks exist in connection with international data transfers and that Take2EU has implemented reasonable legal and technical safeguards to mitigate them.

10.6 User Data Rights

Subject to legal and technical limitations, the User has the right to:

  • Access their Personal Data held by Take2EU.
  • Request correction of inaccurate data or deletion where legally permissible.
  • Object to certain processing or withdraw consent (where processing is based on consent), recognising that this may limit or prevent the provision of some or all Services.
  • Receive a copy of their data in a commonly used, machine-readable, and portable format, where applicable.
